By accessing or using our website you agree to be legally bound by these terms and conditions, as they may be modified and posted on our website from time to time.

Buying products on our website.

To order a product you will need to follow the ordering procedures set out here.

Details of procedures, product, prices, payment and delivery are displayed on our website.

You will get instructions on how to use our online order process and you shall be required to provide use with your personal details. By clicking on the proceed button you are consenting to our terms and conditions. Prices

All prices are listed in the currency relating to the country and all taxes are included.Tha delivery cost are clearly displayed, some items may be subject to delivery surcharges but this is made clear during the ordering process.

We can change the price of an item at any time the price you pay will be the price you accepted when you placed your order. The price on your order will be validated by use as part of the purchasing procedure.

Should a pricing error arise, we will inform you and if you wish to continue with your order at the amended rate you may do so.

Payment

Payment is usually by PayPal or cheque and should be sent when the order is placed at the time of purchase with any additional delivery surcharges. Outdoor play centres direct ltd is entitled to refuse any order placed by you.

If your order is accepted, we will confirm acceptance by email to your address. The order will be fulfilled in 20 working days unless the item is out of stock. If you do not receive a conformation email, please contact use to ensure your order has been processed.

Availability

All products on this website are available almost everywhere within the countries depicted on the flags on the home page...

If the product you order is unavailable we will inform you. In the event we are not able to supply the product to you, we shall notify you as soon as possible and shall reimburse your payment in full.

Arranging and anticipating delivery

The delivery rates are standard across Europe. Deliveries to non main land areas such as the Orkney isles or isolated regions were delivery is more awkward, will insure an extra delivery charge and may possibly an extended lead time. (Please note certain items may not be deliverable to these areas).

Some postcode prefixes may also incur a delivery charge and may be subject to extra charges. For further information regarding delivery please email our customer service team at info@swing-slide-and-play.com in any language depicted on this website.

Due to the nature of contract delivery, additional charges are outside of our control and outdoor play centres direct limited will not be held liable for such costs. By agreeing to accept additional delivery charges should your post code/area necessitate these? You are also agreeing to be bound to all terms and conditions stated in our shipping documents.

Any times or dates stated on our website or conformation emails regarding delivery are estimates only. Out door play

Centres direct ltd attempts to deliver within 20 days, but does not accept any liability for any failure to deliver within that time. Orders received at weekends or public holidays and orders received after 12 pm on week days will be processed the next working day. The delivery service doe not deliver on weekends or public holidays.

Whilst we agree to use all reasonable endeavours to ensure that delivery is made upon the delivery time offered you will acknowledge that actual delivery is via third party suppliers and carries and is therefore beyond our control and we cannot be held responsible for any personal costs incurred if such delays or missed deliveries occur. Incorrect personal details may lead to problems or delays in delivery, so before placing your order, please ensure that you have included the full address details, including accurate postcode of the delivery address and your daytime contact numbers and e-mail address so we can notify you in the event of a delivery problem.

When the delivery arrives

Delivery will be deemed as successfully made once the product has arrived at the address specified. Signatures at the delivery address will be required as proof of delivery. All goods must be signed for by an adult aged 18 years or over.

Your signature is confirmation that all items have been received in good condition. Once you do not sign your courier agreement, the carrier nor swing-slide-and-play can be held liable for damaged goods.

If you find a damaged part, please reject the item and we will organise a replacement for you .Shortages must be noted on the consignment note and swing-slide-and-play must be informed within seven days, so we can send you out any part which is missing.

Couriers do not guarantee their delivery time or date. Parcels can be delayed for different reasons. They may run out of hours/break down or have an accident etc……so please try to allow your self’s extra time in the eventuality of this occurring

As you can imagine there is nothing worse than ordering our product for an important event last minute and finding out there is a delay for one reason or another. So please order the product well in advance to avoid any unwanted stress.

Products will be deemed your responsibility once they have been received by you, your agent or the intended recipient. Any loss or damage to the products shall then be at your own risk. Should delivery be refused at the delivery address, and re-requested for another date, we may charge for the second delivery, since we met our delivery obligations with the initial delivery attempt. Its is the recipient's responsibility to sign for the correct numbers and packages as shown on the carrier's delivery consignment note. Shortages and damages must be noted on the consignment note.

You should notify us of the shortages within 7 days of the delivery. If boxes look damaged on delivery we recommend the contents are inspected before accepting and signing the driver's delivery note.

Cancellations and returns

We endeavour to provide the best Customer Services possible. Should anything go wrong, we will make every effort to resolve the issue. However, should the problem be unsolvable, or you prefer to amend or cancel your order, please email us.

You may cancel your order up to 7 days prior to shipment date. If you cancel your order via telephone your order will be out on hold. You must confirm your wish to cancel the order in writing via email or post within the 10 calendar days. Your order will not be considered cancelled until notification in writing is received. If you decide to cancel an order after the products have been dispatched and commenced their carriage to you by carrier or post, we may charge you for the carriage of those products.

We advise you check the status of the order before you request cancellation.

Any charges will be communicated to you before we confirm the cancellation.

Returns

Before you request or arrange the return of a product, please read the information below carefully. You may return any delivery products you have purchased within 7 days of delivery for any reason. To do so you must notify us in writing via email or post. If you are returning a product for any reason, with the exception of manufacturing defect, you must pay the costs of returning the products to us. All returned products must be returned in original packaging. All components will be checked. We may require photographic evidence of the satisfactory condition of the item you are returning. This will be obviously also accept printed media.

On request, we will get prices from a third party carrier to collect the products from you, Upon receipt with us the products you will receive a refund in line with our refund policy(below)minus the cost of collection. If the products arrive in a damaged condition you must make a note on the carrier's delivery consignment note and inform us within 24 hours of the delivery. We will not accept returns or cancellations if the products have been altered by applying chemicals or paints to the surfaces or by altering or customising the product in any way that could be deemed as you using or treating the products as your own, including fully assembling the products. While in your possession, you must keep any products you intend to return to us in good condition. Products must be returned in the same condition as they were delivered. If products were delivered flat packed they must be returned in the same way including complete disassembly. Care must be taken to ensure the return products are packed well to avoid damage or loss of parts in transit. All advertised sizes and measurements are an approximation but Outdoor Play Centres Direct LTD endeavour to make sure that all are as accurate as possible.

Refunds

Refunds will be processed within 30 days. All refunds will be subject to a £40 administration charge, and will have the original shipping/delivery charge deducted. Where products have been returned directly to us they will be inspected for condition and missing parts and products returned which cannot be re-sold as new due to damage or wear and tear may be subject to a reduction in the refund given. Where exchange rates of currency are involved, the refund will be made in £GBP at the currant exchange rate. We do not accept responsibility for any loss or gain caused by the exchange rate between the time of ordering and the time of issuing the refund. These terms do not affect your statutory rights.

General

We may assign, transfer, novate or subcontract any or all of our rights and obligations under these Terms and Conditions at any time. We may alter these Terms and Conditions from time to time and post the new version on our website, following which all use of our website will be governed by that version. You must check the Terms and Conditions on the website regularly.

These Terms and Conditions together with the private policy, any order form and payment method instructions, if any, are the whole agreement between you and us. You acknowledge that you have not entered into this agreement in reliance upon any statement, warranty or representation made by Us or any other person and you irrevocably and unconditionally waive the rights to claim of any misrepresentation(other than a fraudulent misrepresentation)that is not contained in the Terms and Conditions, privacy policy, order form and payment method instructions. If any provision or terms of these Terms and Conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other Terms and Conditions and shall be deemed to be deleted from them.

These Terms and Conditions and your use of our website are governed by English law and you submit to the non-exclusive jurisdiction of the English court. Except in respect of a payment obligation, neither you nor Outdoor Play Centres Direct will be held liable for any failure to perform any obligation to the other due to causes beyond your Outdoor Play Centres Direct reasonable control

Failure or delay by either patty enforcing an obligation or exercising a right under these Terms and Conditions does not constitute a waive of that obligation or right. These Terms and Conditions do not confer any rights on any person or party (other than you/or us) pursuant to the Contracts (Rights of Third Parties) Act 1999.

We promise that for any product from our website;

If we are liable to you for any reason, our liability will be limited to the amount paid by you for the product concerned. All products and company names and logos mentioned in our website are the trade marks, service marks or trading names of their respective owners, including us, you may download material from our website for the sole purpose of placing an order with us or using our website as a shopping resource. Warranty

We offer a 3 year warranty on structural components against, wood rot, and to be free from defects in workmanship and materials under normal use and conditions. Cosmetic defects that do no effect the structural integrity of the product, or natural defects of wood such as warping, splitting, checking, shrinkage, twisting, swelling or any other physical properties of wood that do not represent a safety hazard are not covered by this warranty

Swing-slide-and-play will repair, or at its discretion, replace any part within the stated warranty period which is defective in workmanship or materials. This decision is subject to verification of the defect upon delivery of the defective part to Swing-slide-and-play.

This warranty is valid only if the product is used for the purpose for which it was designed and installed at a residential, single family dwelling. This warranty is void if the product is put to commercial or institutional use. This warranty does not cover (a) products which have been damaged by acts of Nature, negligence, misuse, or accident, or which have been modified or repaired by unauthorized persons; (b) the cost of labour; or the cost of shipping the product, any part, or any replacement product or part.

This warranty also does not apply to:

Structures not erected, maintained or inspected in conformance with Swing-N-Slide installation plans
Structures that have had parts added or substituted not in conformance with Swing-N-Slide installation plans
Parts that have been modified, altered or misused
Parts that have not been used as designed or intended
Damage due to acts of Nature, vandalism, abnormal use or abuse as determined by Swing-slide-and-play
